Marshall was confirmed as Chief Justice of the Supreme Court in February 1801, but continued to serve as Secretary of State under John Adams until Adams' term expired on March 4.The Constitution forbids a person from serving in the executive and legislative branch at the same time, but not the executive and judicial branch.
